Terms of Use

These Terms govern your use of the Mimasaur apps and website — including Tagasulat (live-selling capture & printing) and Sweldo (HR & payroll). By creating an account or using the service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the service.

1. The service

Mimasaur provides software tools that help you capture buyer pins from your own TikTok Live, print labels, manage buyers, and (optionally) run employee attendance and payroll. Features vary by plan. We may change, add, or remove features over time. Mimasaur is an independent tool and is not affiliated with, endorsed by, or sponsored by TikTok or ByteDance.

2. Eligibility & accounts

You must be at least 18 years old and able to enter a binding contract.
You're responsible for keeping your login credentials secure and for all activity under your account.
One account represents one store. Don't share accounts or create accounts to abuse free trials.
Provide accurate information and keep it up to date.

3. Subscriptions, trials & billing

Free trial. New accounts may receive a free trial. After it ends, a paid plan is required to keep access to paid features.
Payments. Paid plans are processed by PayMongo (GCash, Maya, or card).
Pay-to-renew. Because e-wallets can't be auto-charged, plans renew when you pay again for a new period. Access ends if a plan is not renewed.
No refunds. Payments are non-refundable except where required by law. Cancelling simply means you don't renew; you keep access until your current period ends.
Price changes. We may change prices or plan inclusions. Changes apply to future renewals, and current pricing is always shown on the plans page.

4. Acceptable use

You agree not to:

Use the service for anything unlawful, fraudulent, or harmful.
Violate TikTok's or any third party's terms, rights, or applicable laws while using our tools.
Reverse-engineer, resell, sublicense, or copy the service, or attempt to break its security or gates.
Upload malware, scrape or misuse other users' data, or overload our systems.

5. Your data & responsibilities

You are responsible for the data you put into Mimasaur and for how you use it — including buyer information you capture and, if you use Sweldo, your employees' personal and payroll data. For employee data you are the "data controller" and we are your "processor" (see the Privacy Policy). You confirm you have the right and any required consent to collect and process that data.

6. Intellectual property

Mimasaur, including the apps, website, code, designs, and branding, is owned by us and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the service for your business while your account is in good standing. You keep ownership of your own data. All third-party names and logos (including "TikTok") belong to their respective owners; their appearance does not imply any affiliation.

7. Copyright / IP infringement (notice & takedown)

We respect intellectual property rights and expect users to do the same. Do not upload or store content you don't have the right to use.

If you believe content on the service infringes your intellectual property, email tagasulat.app@gmail.com with: (a) a description of the work and the allegedly infringing material and where it is; (b) your contact details; (c) a statement that you believe the use is unauthorized; and (d) a statement that the information is accurate and that you are the rights holder or authorized to act for them. We will review valid notices and may remove the content or suspend accounts of repeat infringers.

8. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind. In particular:

We do not guarantee that pin capture, OCR, or order matching will catch or read everything correctly — always verify before you ship or charge.
Sweldo payroll and government-contribution figures are provided as a guide based on standard rules and are not a substitute for a licensed accountant or HR professional; you are responsible for verifying final amounts.
Availability may be affected by third parties (e.g. TikTok, payment providers, your devices/internet).

9. Limitation of liability

To the maximum extent permitted by law, Mimasaur is not liable for any indirect, incidental, or consequential damages, or for lost sales, lost profits, or lost or inaccurate data, arising from your use of (or inability to use) the service. Our total liability for any claim is limited to the amount you paid us for the service in the three (3) months before the claim.

10. Indemnity

You agree to indemnify and hold Mimasaur harmless from claims, losses, or expenses arising from your use of the service, your data, or your breach of these Terms or of any law or third-party right.

11. Termination

You may stop using the service anytime. We may suspend or terminate accounts that breach these Terms, abuse the service, or create legal risk. On termination, your right to use the service ends; provisions that by nature should survive (e.g. IP, disclaimers, liability, indemnity) will survive.

12. Governing law

These Terms are governed by the laws of the Republic of the Philippines, and any dispute is subject to the exclusive jurisdiction of the competent courts of the Philippines.

13. Changes

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Continued use after a change means you accept the updated Terms.
