Terms of Use

1. The service

Mimasaur provides software tools that help you capture buyer pins from your own TikTok Live, print labels, manage buyers, and (optionally) run employee attendance and payroll. Features vary by plan. We may change, add, or remove features over time. Mimasaur is an independent tool and is not affiliated with, endorsed by, or sponsored by TikTok or ByteDance.

1a. The pin listener depends on TikTok — and TikTok can stop it

The part of Mimasaur that reads pins from your live (the pin listener) works by connecting to your public live stream the same way a viewer does. TikTok does not offer this as an official service. That means:

• TikTok can change or block it at any time, without notice. When that happens, pins may arrive late, some may be missed, or the listener may stop working entirely — for hours, or for good. We will fix what can be fixed, but we cannot promise the listener will always work.
• The listener is not the whole app. Everything else — the board, printing, order matching, After-Live, waybills, Scan to Pack, buyer history, and Sweldo attendance and payroll — does not depend on TikTok and keeps working. If the listener is down you can still add mines by hand during the live.
• Some parts run through a third-party service that helps open the live connection. That service can also go down or close. We may change which service we use at any time.
• If we ever have to retire the listener for good, we will say so on the site and in the app. Your subscription covers the whole app, not only the listener; you can choose not to renew.

2. Eligibility & accounts

• You must be at least 18 years old and able to enter a binding contract.
• You're responsible for keeping your login credentials secure and for all activity under your account.
• One account represents one store. Don't share accounts or create accounts to abuse free trials.
• Provide accurate information and keep it up to date.

3. Subscriptions, trials & billing

• Free trial. New accounts may receive a free trial. After it ends, a paid plan is required to keep access to paid features.
• Payments. Paid plans are processed by PayMongo. The payment methods offered at checkout (QR Ph, GCash, Maya, cards) depend on what our payment provider has approved and may change over time; the checkout page always shows what is available today.
• Pay-to-renew. Because e-wallets can't be auto-charged, plans renew when you pay again for a new period. Access ends if a plan is not renewed.
• Monthly or yearly. A month is 30 days. A year is 365 days at the price of 10 months. Either one is added on top of whatever time you still have, including trial days.
• Changing plans. Unused paid days keep their value when you change plans: they are converted by the plans' monthly prices (for example, 30 unused Pro days become 50 Basic days). Moving to a cheaper plan is free and immediate; moving to a bigger plan is a paid checkout, and your unused days convert the same way. No cash refunds are made for unused time.
• Launch price. While a plan is marked "Launch price", the price you pay stays the same for as long as you keep renewing without a gap. A later price change applies to new subscribers, and to you only if your plan lapses and you subscribe again.
• No refunds. Payments are non-refundable except where required by law. Cancelling simply means you don't renew; you keep access until your current period ends. This includes periods when the pin listener is affected by TikTok (see section 1a) — the rest of the app stays available. If the listener stops early in a period you've just paid for, message us and we'll look at it.
• Price changes. We may change prices or plan inclusions. Changes apply to future renewals, and current pricing is always shown on the plans page.

4. Acceptable use

You agree not to:

• Use the service for anything unlawful, fraudulent, or harmful.
• Violate TikTok's or any third party's terms, rights, or applicable laws while using our tools.
• Reverse-engineer, resell, sublicense, or copy the service, or attempt to break its security or gates.
• Upload malware, scrape or misuse other users' data, or overload our systems.

5. Your data & responsibilities

You are responsible for the data you put into Mimasaur and for how you use it — including buyer information you capture and, if you use Sweldo, your employees' personal and payroll data. For employee data you are the "data controller" and we are your "processor" (see the Privacy Policy). You confirm you have the right and any required consent to collect and process that data.

6. Intellectual property

Mimasaur, including the apps, website, code, designs, and branding, is owned by us and protected by law. We grant you a limited, non-exclusive, non-transferable license to use the service for your business while your account is in good standing. You keep ownership of your own data. All third-party names and logos (including "TikTok") belong to their respective owners; their appearance does not imply any affiliation.

7. Copyright / IP infringement (notice & takedown)

We respect intellectual property rights and expect users to do the same. Do not upload or store content you don't have the right to use.

If you believe content on the service infringes your intellectual property, email hello@mimasaur.app with: (a) a description of the work and the allegedly infringing material and where it is; (b) your contact details; (c) a statement that you believe the use is unauthorized; and (d) a statement that the information is accurate and that you are the rights holder or authorized to act for them. We will review valid notices and may remove the content or suspend accounts of repeat infringers.

8. Disclaimers

The service is provided "as is" and "as available," without warranties of any kind. In particular:

• We do not guarantee that pin capture, OCR, or order matching will catch or read everything correctly — always verify before you ship or charge.
• Sweldo payroll and government-contribution figures are provided as a guide based on standard rules and are not a substitute for a licensed accountant or HR professional; you are responsible for verifying final amounts.
• Availability may be affected by third parties (e.g. TikTok, the live-connection service, payment providers, your devices/internet). See section 1a.

9. Limitation of liability

10. Indemnity

You agree to indemnify and hold Mimasaur harmless from claims, losses, or expenses arising from your use of the service, your data, or your breach of these Terms or of any law or third-party right.

11. Termination

You may stop using the service anytime. We may suspend or terminate accounts that breach these Terms, abuse the service, or create legal risk. On termination, your right to use the service ends; provisions that by nature should survive (e.g. IP, disclaimers, liability, indemnity) will survive.

12. Governing law

These Terms are governed by the laws of the Republic of the Philippines, and any dispute is subject to the exclusive jurisdiction of the competent courts of the Philippines.

13. Changes

We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date. Continued use after a change means you accept the updated Terms.
